1. Applicability

1.1 These terms and conditions apply exclusively to all offers, orders, and agreements between the customer and FAM Flower Farm.

1.2 Deviations from or additions to these terms are only valid if expressly accepted by FAM Flower Farm in writing.

1.3 Any customer who has once entered into an agreement with FAM Flower Farm under these terms agrees that these conditions will also apply to all future agreements.

2. Formation of the Agreement

2.1 A purchase agreement between FAM Flower Farm and the customer is established once the customer completes and pays for an order using the ordering process provided on the website.

3. Prices & Discounts

3.1 Offers and promotions are valid while supplies last.

3.2 Personal discount codes are intended to attract new paying customers from the user’s direct circle (e.g. via word-of-mouth, social media, or email). FAM Flower Farm discount codes may not be used for commercial purposes or for any other purpose than originally intended. It is strictly prohibited to use the brand name “FAM Flower Farm” (or any misspelling of it) in URL combinations to generate traffic for the distribution of discount codes.

3.3 Any form of fraud or unauthorized use of discount codes will be registered and will result in the revocation of the customer’s right to use such codes. FAM Flower Farm reserves the right to retroactively deduct any misused discount or accrued credit.

4. Payment

4.1 Customers may only use the payment methods offered by FAM Flower Farm.

4.2 Payment is due immediately upon purchase.

4.3 If payment is not received immediately, FAM Flower Farm reserves the right to cancel the order without notice. The right to claim damages or collect overdue payments (including collection fees) remains unaffected.

4.4 Invoices and payment reminders are provided exclusively in digital form.

5. Delivery

5.1 We ship to the Netherlands, Belgium, Bulgaria, Denmark, Germany, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Spain, Czech Republic, and Sweden.

5.2 Deliveries are made at the customer’s expense to the shipping address provided during the ordering process.

5.3 The customer (i.e. the recipient of the order) will be considered the declarant and importer in the destination country.

5.4 The customer is responsible for ensuring that the delivery can be received at the specified address.

5.5 If delivery is not possible, the parcel may be delivered to a nearby address, such as a neighbour.

5.6 If payment has not been received in full by the time of delivery (as outlined in section 4), FAM Flower Farm retains ownership of the goods until full payment is completed.

6. Right of Withdrawal

6.1 Customers have the right to cancel their purchase within 14 days of receiving the product, without giving a reason.

6.2 Perishable items (such as fresh flowers) are excluded from the right of withdrawal.

6.3 During the withdrawal period, customers must handle the product and packaging with care. Products may only be unpacked or used as necessary to assess whether the customer wishes to keep them. To exercise the right of withdrawal, the customer must contact FAM Flower Farm by email. Upon request, the product (with all accompanying materials and in original condition if reasonably possible) must be returned in accordance with the return instructions provided.

6.5 Return shipping costs are the responsibility of the customer.

6.6 If the customer has already paid for the returned products, FAM Flower Farm will refund the amount (minus any shipping or payment transaction fees such as bank, PayPal, or credit card charges) within 30 days of receiving the returned items.

7. Data Protection

7.1 When processing an order, we handle the customer’s personal data. Our privacy policy outlines how we use and protect this information.

8. Warranty & Liability

8.1 FAM Flower Farm only guarantees that its products are suitable for their intended use, based on the information provided on the website, and that they comply with applicable legal requirements.

8.2 We guarantee that our products and services are produced and delivered with respect for people and the environment, without the use of child labour.

9. Changes to Terms

9.1 FAM Flower Farm reserves the right to update these terms and conditions at any time. We recommend reviewing them regularly.

10. Termination of Agreement

10.1 If the customer fails to meet their obligations under these terms, FAM Flower Farm may either offer the opportunity to correct the issue within a set timeframe, or terminate the agreement entirely without further notice. In all cases, FAM Flower Farm reserves the right to seek full compensation for any resulting damage or costs.

11. Disputes & Applicable Law

11.1 All agreements and obligations between FAM Flower Farm and the customer are governed by Dutch law.

11.2 Any disputes arising from or relating to the agreement will be handled exclusively by the District Court of Amsterdam, The Netherlands.
